CMS Extends Low Volume Payment Adjustment Attestation Period Through January 30, 2026

The Centers for Medicare & Medicaid Services (CMS) Low Volume Payment Adjustment attestation period has been extended. Congress recently passed a short-term temporary extension, extending the deadline to January 30, 2026, through Transmittal 13564 (Change Request 14341).

To be eligible for Low Volume Hospital status, the acute care facility must meet the following criteria:

  • Be located more than 15 road miles from another subsection (d) hospital
  • Have fewer than 3,800 total discharges on W/S S-3, Part 1, Line 1, Col. 15, as supported by the most recently filed cost report as of the date of the low volume request

Blue & Co. experts recommend that any providers who qualify for this payment adjustment examine their records to ensure they have properly attested.  Many providers initially attested during the August 2025 window; however, MACs have been communicating to providers that resubmission of this information may be necessary to continue receiving the payment adjustment.

Facilities that have been approved for low-volume status should be reinstated retroactively to October 1, 2025.
